Eastlink Freeway Service Centres (Amendment C201knox)

We received a proposal that seeks to apply planning controls to parts of 1500 and 1501 Eastlink, Scoresby to enable the existing use of the land as freeway service centres to continue.

About the land and Amendment

The land was included in the Eastlink Project area and Extended Project area (Project area) to enable development and use as freeway service centres without planning approval, with reliance on an exemption in the EastLink Project Act 2004. The freeway service centres have operated since 2012.

The land will soon be removed from the Project area, and be subject to the permit requirements of the Knox Planning Scheme. Under the Knox Planning Scheme, there are components of each freeway service centre which would render them prohibited under Clause 53.05 (Freeway Service Centre).

To enable the existing use of the land as freeway service centres to continue, the Amendment seeks to apply planning controls (Specific Controls Overlay), to give effect to incorporated document ‘Eastlink Freeway Service Centres (2023)’.

Exhibition and next steps

On 20 November 2023, the Minister for Planning granted an exemption, to allow for limited notice of the Amendment due to its administrative nature.

The Amendment was placed on exhibition from 28 February 2024 until 5pm 28 March 2024, with notice given to prescribed Ministers and select authorities.

One submission of support was received, and the Amendment proceeded to a Council meeting on 22 April 2024 for Council to decide on whether to adopt or abandon the Amendment.

Council adopted the Amendment, and it has been submitted to the Minister for Planning for approval.

The amendment was approved on 5 June 2024. It will come into effect after a notice is published in the Victoria Government Gazette.
